Texas Heartbeat Act Scores a Victory in the Fort Worth Court of Appeals

In a pivotal ruling, the Fort Worth Court of Appeals rejected an abortion fund’s attempt to sue a potential “bounty hunter” under the Texas Heartbeat Act, marking a substantial triumph for the Pro-Life movement.

The lawsuit began after Texas Equal Access Fund, an organization that funds or has funded illegal abortions for Texas women, sued Texas Right to Life and stated in a sworn declaration that they paid for at least one illegal abortion in violation of the Texas Heartbeat Act. When private citizen Ashley Maxwell began investigating Texas Equal Access Fund, the fund filed a countersuit to block her from challenging their violation of the Heartbeat Act.

The Fort Worth Court of Appeals ruled against the abortion fund, affirming the lower court’s decision and Ashley Maxwell’s ability to move forward with legal action under the Texas Heartbeat Act. The court also upheld an award of over $35,000 in attorney’s fees in favor of Ashley Maxwell. This decision sends a powerful message that any attempts to exploit Pro-Life citizens who would use the Heartbeat Act to fight for the lives of unborn babies will not be tolerated.

Texas became the first state ever to enforce a heartbeat bill. The Texas Heartbeat Act, which went into effect on September 1, 2021, prohibits abortions once a fetal heartbeat is detected and empowers private citizens to bring civil lawsuits against anyone who performs or aids and abets an abortion in violation of the law.

The court’s ruling marks a significant milestone in ongoing legal battles surrounding the Texas Heartbeat Act, including the 14 lawsuits against Texas Right to Life and President Dr. John Seago. This decision reinforces the Texas Heartbeat Act’s impact and sets a precedent for future cases.
