Top Democrats are urging the U.S. Food and Drug Administration (FDA) to ignore a court’s order restoring safeguards on an abortion-inducing drug nationwide.
The ruling does not change the status quo in Pro-Life states like Texas where the Right to Life of all preborn children is legally recognized. However, in several other states without strong prohibitions on abortion, the order reestablishes multiple safety guidelines that had been waived by pro-abortion presidential administrations.
An appeals court Wednesday blocked the FDA’s approval of mail-order abortions and limited the use of the abortion pill mifepristone to seven weeks instead of 10.
The ruling is a partial victory for Pro-Life advocates, but the appeals court reduced the life-saving impact the case could have had by choosing to keep the abortion drug on the market.
Pro-abortion groups and politicians, however, are furious.
Some officials and allies of the Biden administration are suggesting that they are willing to work outside the rule of law to continue killing preborn children as-is.
Xavier Becerra, Secretary of Health and Human Services, stated on Easter Sunday that ignoring the federal ruling against the FDA’s approval of mifepristone was “on the table.”
White House Press Secretary Karine Jean-Pierre, on the other hand, appeared to walk back Becerra’s rhetoric during a press conference, stating that the Biden administration is seeking legal means to fight the decision “vigorously.”
She claimed that the ruling against the FDA sets a dangerous precedent, but emphasized that disregarding the judge’s decision would be dangerous as well, as there is a process in place for appealing such decisions. The Biden administration announced Thursday it will immediately appeal the case to the Supreme Court.
In an interview with CNN’s Dana Bash, Congresswoman Alexandria Ocasio-Cortez expressed her belief that the courts do not have authority over the FDA and suggested that the FDA should “simply ignore” the ruling. CNN’s anchor appeared surprised by the suggestion, calling it a “stunning position.”
Senator Ron Wyden, who chairs the Senate Finance Committee, also voiced his support for ignoring the ruling, stating that he believes the FDA has the authority to do so, and he called on President Biden and the FDA to take action. Wyden further encouraged abortionists to disregard the ruling and continue killing preborn children uninterrupted.
The legal battle over this abortion drug will likely be fast-tracked to the U.S. Supreme Court.
