Pro-Life hero David Daleiden won a victory for the Pro-Life cause on July 18, when a federal
judge in San Francisco decided to cut back substantially the damages Planned Parenthood could
claim in a bogus lawsuit against Daleiden and the Center for Medical Progress (CMP).
In 2015, Daleiden released undercover videos of Planned Parenthood officials discussing the sale
of tissues and organs from the preborn babies they had murdered. Abortion advocates have
claimed the footage was doctored, but the United States Court of Appeals for the Fifth Circuit
ruled that the footage was authentic, and allowed Texas to remove Planned Parenthood’s
taxpayer subsidies.
Since releasing these shocking videos, Daleiden has faced massive legal persecution in Texas
and California. One prosecution occurred in Harris County, Texas, for charges of offering to buy
fetal tissue and using a fake driver’s license — all charges were dismissed.
In 2017, the California Attorney General went after Daleiden again, filing 15 bogus felony
charges of conspiracy to record confidential communications; as though Daleiden should be
prosecuted for revealing the truth, not Planned Parenthood for the horrifying truth Daleiden
revealed! Fourteen of the charges were dropped, but liberal activist Judge William Orrick still
put Daleiden and his attorneys on the hook for the National Abortion Federation’s legal fees!
Possibly emboldened by this show of anti-Life bias, Planned Parenthood leaders launched a
retaliatory lawsuit against Daleiden and the Center for Medical Progress, claiming the released
video was an attempt to incite “threats” and “violence.” They tried to claim damages from third
parties’ reactions to the video, which raised the stakes to over $20 million.
However, in a surprising ruling, Judge Orrick ruled that he would exclude any damages from
others’ reactions to the videos, because the First Amendment protects Daleiden in this case. He
decided to lower the stakes of the case to only “damages for investigating intrusions” and
“improvements to access-security measures for conferences and facilities;” these costs would
still be an estimated $100,000 if Daleiden and CMP are found liable.
In short, once Daleiden showed the world the truth about Planned Parenthood’s corruption and
illegal fetal organ cartel, Planned Parenthood urged cronies in two state governments to shut him
down. Texas and the Fifth Circuit stood up for justice in this case. Now, even a biased, anti-Life
judge in San Francisco, who unjustly made Daleiden and CMP pay massive legal fees only two
years ago, has ruled that Planned Parenthood is going too far in persecuting this brave
whistleblower.
