The U.S. Supreme Court allowed abortion pills to continue being sent in the mail nationwide while they consider this major case.

Today’s order is not the final outcome. Justices will hold hearings over the next year and then decide whether the FDA must require abortionists to have in-person appointments before they give out abortion pills—instead of shipping the drugs. However, this ruling is an early sign that the court will side with the FDA, in favor of abortion pills.

The case began in 2023 after Joe Biden’s Food and Drug Administration weakened safety standards on abortion pills, allowing the drugs to be prescribed online and sent in the mail. Louisiana then sued the FDA.

If the FDA wins when the final outcome is decided, nothing would change. If the Pro-Life side ultimately wins, it could save thousands of babies and protect vulnerable women.

However, no matter what the court does, this lawsuit isn’t the Pro-Life movement’s only way to stop mail-order abortions. President Donald Trump could immediately order the FDA to restore the in-person requirement, reduce the timeframe that the drugs are allowed for use, or even revoke approval of the abortion pill altogether.

Tell President Trump to stop mail-order abortions!

Texas Right to Life President Dr. John Seago stated:

We shouldn’t have to depend on the court to force the FDA to do the right thing. The administration could choose to restore the in-person requirement themselves right now. Safeguards like these are the bare minimum. Washington should be doing more to protect all babies and their mothers from the violence of abortion.”

Abortion pills are now the most common way preborn children are killed. They make up more than half of the 1.1 million abortions in America each year.

If the FDA adopts better safeguards, even Democratic states will have to enforce another step before dispensing the deadly pills. Pro-Life states like Texas that ban abortion would also see an impact. Over the last few years, abortionists in liberal regions illegally mailed the drugs to homes and dorm rooms all over the country. With stronger FDA regulations, these activists can’t rely on pro-abortion “Shield laws” to hide from accountability. They could lose their licenses, face huge fines, and risk criminal penalties.

Chemical abortions use two drugs. The first, mifepristone, kills the baby by starving him or her to death. The second, misoprostol, causes the woman to deliver the deceased child.

This lawsuit only deals with mifepristone.

However, pro-abortion groups are already dodging the FDA in two major ways:

  1. They’re using pharmacists in other countries to keep sending these deadly drugs.
  2. They’re resorting to a more barbaric method: abortions using only one pill (misoprostol) instead of two, causing the mother to deliver a live baby in the toilet.

By the time most abortions take place, the baby has her own unique DNA; her heart starts beating; her eyes, legs, and hands begin to develop; she has detectable brain waves; and every major organ system is in place.

Plus, restoring the rule for in-person exams is common sense. Without an in-person appointment, doctors cannot tell if the mother has an ectopic pregnancy or other conditions that could be life-threatening if untreated. A recent study found that over 1 in 10 women who attempt a chemical abortion face severe medical complications—this is 22 times more dangerous than the FDA currently reports. Even then, this number may not capture the full damage.

America still needs the federal government to do more to end the legalized killing of babies in the womb. This court ruling is disappointing, but the Trump administration still has the power to save lives and protect women by taking stronger action against abortion pills.
