The U.S. Supreme Court issued a temporary order Monday allowing abortion pills to continue being sent in the mail nationwide. The one-sentence decision from Justice Samuel Alito paused a lower court ruling from Friday that required an in-person appointment for all abortions in America. Alito asked the FDA and the State of Louisiana to file briefs by Thursday. Then, the full court will determine how to proceed.

This case came after Joe Biden’s Food and Drug Administration loosened safeguards on abortion pills in 2023, prompting a lawsuit from Louisiana. Biden’s FDA removed the requirement for an in-person visit for an abortion, allowing deadly pills to be sent in the mail.

If the Pro-Life side ultimately wins, it could save thousands of babies and protect vulnerable women. If the FDA wins, nothing would change.

However, a court case isn’t the Pro-Life movement’s only path to stop mail-order abortions. President Donald Trump could immediately order the FDA to require in-person visits, restore stronger regulations, or even revoke approval of the abortion pill altogether. 

Tell President Trump to stop mail-order abortions!

If the FDA adopts better safeguards, even Democratic states will have to enforce another step before dispensing the deadly pills. Pro-Life states like Texas that ban abortion would also see an impact. Over the last few years, abortionists in liberal regions illegally mailed the drugs to homes and dorm rooms all over the country. With stronger FDA regulations, these activists can’t rely on pro-abortion “Shield laws” to hide from accountability. They could lose their licenses, face huge fines, and risk criminal penalties.

Abortion pills have become the most common method of killing preborn children, making up more than half of the 1.1 million abortions in America each year. 

Chemical abortions involve two drugs: The first, mifepristone, kills the baby by starving him or her to death, and the second, misoprostol, causes the woman to deliver the deceased child.

This lawsuit only applies to mifepristone.

By the time most abortions take place, the baby has her own unique DNA; her heart starts beating; her eyes, legs, and hands begin to develop; she has detectable brain waves; and every major organ system is in place.

Plus, at-home abortions are dangerous. Without an in-person appointment, doctors cannot tell if the mother has an ectopic pregnancy or other conditions that could be life-threatening if untreated. A recent study found that over 1 in 10 women who attempt a chemical abortion face severe medical complications—this is 22 times more dangerous than the FDA currently reports. The in-person requirement also helps protect pregnant women from being poisoned by abusive partners

America needs the federal government to do more to completely end the legalized killing of babies in the womb. This lawsuit is a good step, but no matter the outcome of the case, the Trump administration has the power to save children today and protect pregnant women by cracking down on abortion pills.
