In December, the U.S. Supreme Court dismissed several key defendants in the abortion industry’s federal lawsuit. However, the justices allowed the case to continue only with a few state agencies named in the lawsuit.
Because the Texas Heartbeat Act was specifically written to preclude government officials from enforcing it, this case likely won’t block the law. The Supreme Court of Texas will evaluate whether these state agencies have the authority to enforce the Texas Heartbeat Act under the state Constitution and statutes. Meanwhile, March 1 will mark six months that the law has been in effect.
