Texas and Florida have filed a lawsuit against the U.S. Food and Drug Administration (FDA) to block abortion pill mifepristone after the agency dangerously approved a new generic version of the drug.
A lawsuit was filed in federal court by Texas Attorney General Ken Paxton and Florida Attorney General James Uthmeier in Wichita Falls on December 9, 2025. Both states challenge the FDA’s original approval of mifepristone in 2000 and its recent approval of a new generic version.
The FDA horrifically approved a new generic version of mifepristone manufactured by Evita Solitons in September of 2025. Health Secretary Robert F. Kennedy Jr. said the agency is legally required to approve generics that are identical to the brand-name drug.

The lawsuit also challenges rule changes made during the Obama and Biden administrations that made the drug easier to get. These changes allowed abortion pills to be prescribed through telehealth and mailed directly to women. By eliminating in-person doctor visits, women may not be fully informed about the serious risks of abortion. These policies also remove the opportunity for physicians to screen for a blood type mismatch or ectopic pregnancy. If left undiagnosed, these conditions can cause future infertility or even lead to a woman’s death.
This comes after the FDA announced it had delayed its own safety study on mifepristone.
Abortion pills are lethal. They end the life of a preborn child while putting women at serious risk. Abortion pills are 22 times more dangerous than the FDA has reported. About 1 in 10 women who take abortion pills experience severe or life-threatening problems such as heavy bleeding, infection, or sepsis. Tragically, some women, including Amber Thurmann and Candi Miller, have died from taking abortion pills.
The lawsuit states:
The United States Food and Drug Administration is responsible ‘for protect[ing]the public health by ensuring that … drugs are safe and effective.’ Yet the FDA’s approval and deregulation of abortion drugs have placed women and girls in harm’s way.
This isn’t Texas’s first attempt to stop these deadly abortion drugs. Back in 2021, Texas tried to join a lawsuit filed by a group of Pro-Life doctors. As the case moved forward, Missouri, Kansas, and Idaho took the lead, challenging the FDA’s decision to allow abortion pills to be prescribed through telehealth and shipped through the mail. Texas asked to join the case but was turned away after it was moved to a different court.
