Supreme Court Justice Temporarily Reinstates Abortion Pill

Supreme Court Justice Samuel Alito temporarily blocked a lower court’s Pro-Life ruling that would have taken an abortion drug off the market. Alito’s disappointing decision means that abortion drugs will continue to kill preborn children in states without strong abortion bans, but Pro-Life states like Texas will be unaffected.

After a Texas judge ruled last week to revoke FDA approval of mifepristone, which is one of two drugs used to cause chemical abortions, the Biden administration appealed to the Fifth Circuit Court of Appeals and then to the U.S. Supreme Court. 

Texas Right to Life President Dr. John Seago responded, “While we are still optimistic about the outcome of this lawsuit, Friday’s ruling is a reminder that in this new chapter of the Pro-Life movement, we cannot take anything for granted.”

The Supreme Court’s full consideration of this case could be a monumental victory for the movement. If the justices ultimately rule on the side of Life, it could stop abortionists nationwide from using mifepristone to end the lives of preborn children, including in liberal states like California and New York. 

Federal District Judge Matthew Kacsmaryk of the Northern District of Texas ruled last week that the FDA failed to follow proper protocol and neglected its duty during the initial approval and subsequent changes to the rules for using mifepristone to end the lives of preborn children. An appeals court ordered some safeguards to be restored but neglected to take the drug entirely off the market when used for abortion.

Chemical abortions will continue as-is in states that do not protect preborn children until Alito’s order expires on Wednesday. Within that time, all nine justices will likely consider the Biden administration’s appeals.

As this case progresses, Texas Right to Life will continue working in the Texas Legislature to stop dangerous new trends like anti-Life groups sending abortion drugs illegally through the mail or trafficking them over our southern border. Texas Right to Life is also spearheading efforts to increase resources for pregnant women and families, such as making adoption affordable, removing barriers for student parents at universities, and funding Alternatives to Abortion.
