Pro-Abortion Supreme Court Justice Stephen Breyer to Retire, per NBC Special Report

Liberal Supreme Court Justice Stephen Breyer, who served on the high court for 27 years, is rumored to retire, according to NBC. Breyer himself has not confirmed his departure, but multiple news organizations report that Joe Biden was expected to announce the matter this week.

Breyer is one of the only three liberal justices left on the court, and his replacement would be Joe Biden’s first Supreme Court nominee. Biden promised to only appoint justices who support abortion on demand until birth.

Luckily, Breyer is not expected to step down until after the court rules on the Mississippi case that could overturn Roe v. Wade this summer. Even in the long-term, Breyer’s retirement would not change the dynamic of 6 Republican-appointed justices to 3 Democrat-appointed justices.

In Breyer’s tenure, he has voted against the Texas Heartbeat Act, against health and safety regulations for abortion facilities, and against the Partial-Birth Abortion Ban.

Likely contenders for Breyer’s replacement could include U.S. Circuit Judge Ketanji Brown Jackson of the Court of Appeals for the District of Columbia, a former Breyer law clerk; and Leondra Kruger, a justice on California’s Supreme Court.

Senate Majority Leader Chuck Schumer pledged that Biden’s nominee will “receive a prompt hearing in the Senate Judiciary Committee, and will be considered and confirmed by the full United States Senate with all deliberate speed.”

Some political pundits question the timing of Breyer’s rumored departure, suggesting that the liberal judge aims to retire before Democrats might lose the Senate in the upcoming midterm election. Left-wing activists pressured Ruth Bader Ginsburg to step down during the Obama administration due to her long-term health problems. Ginsburg’s death from cancer in 2020 then allowed President Donald Trump to nominate her successor, Justice Amy Coney Barrett. Since then, Breyer “became the subject of an energetic campaign by liberals who wanted him to step down to ensure that Mr. Biden could name his successor while Democrats control the Senate,” The New York Times reported.

Conservative columnist Kurt Schlichter tweeted. “If you need proof that the Dems think the GOP wins the Senate in November, there you are.”

“The Democrats know they will lose the Senate majority in 2022,” Sen. Rick Scott (R-FL), chairman of the National Republican Senatorial Committee (NRSC), said in a statement. “I predict that Chuck Schumer and whoever is running the White House will force all Democrats to obey and walk the plank in support of a radical liberal with extremist views.”

Pro-Life advocates must be diligent in opposing any anti-Life nominee.
