A heartbreaking tragedy out of New Mexico is reminding our nation why safe haven laws matter.

38-year-old Sonia Jimenez has been charged after allegedly giving birth to a baby girl during a lake trip and leaving the newborn in a portable toilet, where the infant died. Jimenez’s boyfriend brought her to Memorial Medical Center, and it became clear she had just delivered a baby. Hospital staff quickly contacted police after realizing the child was not with her.

Officers responded to the lake and searched the portable restrooms. Inside the holding tank of one unit, they discovered the body of a baby girl.

“Investigators believe Jimenez gave birth to a live baby, cut the umbilical cord, and placed the child in the holding tank where she drowned,” the Las Cruces Police Department stated.

An autopsy later confirmed that the baby was alive when she was placed in the portable toilet and that “she breathed and swallowed the blue chemical liquid commonly used in portable restroom sanitation.”

Las Cruces Police Chief Jeremy Story called it “one of the most heartbreaking and disturbing cases I have encountered in my career.”

It is hard to imagine the fear, panic, or desperation that may have surrounded this situation. But it is even harder to imagine the suffering of a newborn baby girl who was alive, breathing, and fighting for Life.

In Texas, we have a law specifically designed to prevent deaths like this. The Baby Moses Law, also known as the Texas Safe Haven Law, allows a parent to safely and legally surrender a newborn who is 60 days old or younger at a hospital, fire station, or emergency medical services station. No questions. No criminal charges. No shame. The goal is simple: protect the life of the child while offering the parent a safe way out of a crisis.

A mother in Texas can walk into a hospital and hand her baby to a nurse. She can go to a fire station and place her child in safe hands. The baby will receive medical care and be placed with a loving family through adoption. The mother will not be prosecuted for making that decision.

Sadly, not every state publicizes or promotes safe haven laws as strongly as they should, even though there is one in New Mexico. Stories like this one reveal just how important it is to spread the word. A newborn baby should never die alone in a sewage tank.

Every child, no matter the circumstances of conception or birth, deserves a chance at Life. That little girl in New Mexico had a heartbeat. Her life had value from the very first moment.

Pro-Life advocacy is not only about changing laws. It is also about ensuring that safe haven policies like the Baby Moses Law are widely known and easily accessible.
