In a major victory for the protection of Texas women and unborn children, Texas Attorney General Ken Paxton has filed a lawsuit against out-of-state abortionist Debra Lynch. The lawsuit targets Lynch’s illegal abortion-by-mail operation, Her Safe Harbor, for knowingly prescribing and mailing abortion-inducing drugs into Texas in violation of the state’s Pro-Life laws.
Debra Lynch, a nurse practitioner based in Delaware, operates Her Safe Harbor, also known as Delaware Community Care, LLC. From her home state, she has deliberately targeted Texas residents. Lynch has openly admitted that she “mails a lot [of abortion drugs] to Texas,” boasting about her operation’s reach despite Texas’s abortion bans. Even bragging, Her Safe Harbor sends roughly 162 abortion pill orders per week to Texas – nearly 8,500 a year.
But that ends now.
According to the Attorney General’s suit, Lynch is not a licensed physician and does not hold a Texas medical license. Nevertheless, she has used telemedicine consultations to send abortion drugs and personally participated in packaging and mailing these pills across state lines. Each shipment represents a separate violation of Texas law.

The lawsuit makes clear that Lynch’s actions violate the Human Life Protection Act, which prohibits knowingly performing, inducing, or attempting an abortion except in rare, life-saving circumstances and only when carried out by a licensed Texas physician. The suit also alleges violations of Texas laws prohibiting the unlicensed practice of medicine. Under state policy, each violation of the law carries civil penalties of at least $100,000, in addition to other potential penalties.
Lynch’s operation is part of a growing network of rogue abortion traffickers who exploit out-of-state “shield laws” while intentionally targeting Texas women and defying the will of Texas voters to protect preborn Life. Even after receiving a cease-and-desist letter from the attorney general, Lynch publicly stated that her organization would continue operating and that she does not fear fines or jail time.
Attorney General Paxton responded, stating,
“The day of reckoning for this radical out-of-state abortion drug trafficker is here. No one, regardless of where they live, will be freely allowed to aid in the murder of unborn children in Texas.”
This lawsuit is a critical step toward real accountability for those who endanger women and kill preborn children while attempting to undermine Texas’s Pro-Life protections. Texas Right to Life applauds Attorney General Paxton for his strong leadership and commitment to enforcing the safeguards.
With elections around the corner, Texas looks toward the next attorney general to show this same drive in defending mothers and their babies. We also excitedly anticipate the full enforcement of the Woman and Child Protection Act to combat abortion pills as we strive for a day when abortion is not only illegal, but unthinkable.
Texas stands firm in the truth that Life is precious, the law matters, and those who violate our Pro-Life protections will be held accountable.
