Appeals Court Keeps Texas Heartbeat Act in Place

The Fifth Circuit Court of Appeals ruled Thursday evening to allow the Texas Heartbeat Act to remain in effect. In a 2-1 order, the three-judge panel denied the Biden administration’s plea to reinstate a lower court’s anti-Life ruling that previously blocked enforcement of the Texas Heartbeat Act.

The appeals court issued a temporary ruling last Friday to immediately restore the law to full effect. This week, judges evaluated arguments from each side and allowed the law to remain in place while litigation proceeds.

Texas Right to Life Director of Media and Communication Kimberlyn Schwartz responded:

“We are excited to continue saving hundreds of lives through the Texas Heartbeat Act. However, the battle is not finished. We expect the Biden administration to appeal to the Supreme Court of the U.S., and we are confident Texas will ultimately defeat these attacks on our life-saving efforts.”
