Organs Harvested From Living Patients, Investigation Finds

The U.S. Department of Health and Human Services (HHS), led by Robert F. Kennedy Jr., has announced sweeping reforms to the nation’s organ transplant system following serious evidence of unethical practices.

The investigation was sparked by the shocking case of TJ Hoover, a man from Kentucky who was declared brain dead but woke up an hour into organ harvesting. Federal investigators focused on the nonprofit responsible for coordinating organ donations across Kentucky, southwest Ohio, and parts of West Virginia. The Health Resources and Services Administration (HRSA), an agency within the HHS, reviewed 351 cases from the past four years where organ donation was approved but not completed. Alarmingly, 103 of those cases raised serious concerns.

Secretary Kennedy stated, “Our findings show that hospitals allowed the organ procurement process to begin when patients showed signs of life…”

Specifically, the investigation found 73 cases where patients had neurological signs incompatible with organ donation. At least 28 patients may not have been deceased at the time organ procurement was even initiated. Multiple patients also showed signs of distress while being prepared for harvesting.

Further findings uncovered poor neurological assessments, questionable consent practices, a lack of coordination with medical teams, and other serious issues. In fact, the Health and Human Services Department announced that it had uncovered clear evidence of misconduct involving the Network of Hope, an organ collection group based in Kentucky. Notably, this same organization was responsible for handling TJ’s case.

Ethical concerns surrounding organ donation groups have persisted for years, but only recently has the public begun to fully grasp the troubling realities of the system. Reports of questionable practices and lack of oversight are bringing long-standing issues to light. Following TJ’s story, more than 1,000 people withdrew their names from the Kentucky organ donor registry.

Central to this issue is the “Dead Donor Rule”, which states that a patient must be dead before any organs are removed for transplantation. Although this rule remains the guiding principle today, it is often ignored in practice. We must be certain that someone has died before organ harvesting begins. We must make sure that a patient’s respiratory and circulatory function has ceased, that every organ and system has shut down. Taking organs before death violates both medical ethics and human rights.

Thousands of people are currently in need of life-saving transplants. While the demand for organs exceeds the supply, this imbalance cannot justify treating donors as mere means to an end. Every donor is a human being whose life and dignity must be respected.

In response to the investigation, Secretary Kennedy stated, “The entire system must be fixed to ensure that every potential donor’s life is treated with the sanctity it deserves.”

One major factor contributing to these ethical failures is that hospitals and organ collection agencies receive financial compensation for the organs they recover. This creates a system where these institutions directly profit from organ harvesting, raising serious ethical concerns and contributing to questionable practices within the donation process.

In response to ongoing ethical concerns, Health and Human Services has mandated a series of reforms. This includes clearer guidelines for determining donor eligibility and safeguards to stop procedures when patient safety is at risk. The department also called for updated safety protocols across the nationwide donor network and mandated reporting of any safety-related stoppages to federal regulators.
