A study published in the Journal of the American Medical Association showed that Texas had 9,799 more births than expected between April and December 2022, following implementation of the Texas Heartbeat Act.
“Although our study doesn’t detail why these extra births occurred, our findings strongly suggest that a considerable number of pregnant individuals in Texas were unable to overcome barriers to abortion access,” said Alison Gemmill, PhD, assistant professor in the Bloomberg School’s Department of Population, Family and Reproductive Health and a lead author of the study.
Texas became the first state ever to enforce a heartbeat bill. Texas Right to Life played a key role in the policy, including by educating citizens about their ability to hold abortionists accountable if they illegally kill a preborn child.
Planned Parenthood and 13 other pro-abortion advocates sued Texas Right to Life.
Their lawyer even said in court, “Texas Right to Life is the biggest threat to Planned Parenthood.”

Now, two years later, we are still fighting these lawsuits. This case is abortionists’ last legal challenge against the historic enforcement mechanism that allows private citizens to sue abortion providers. They hope that the civil liability section of the Texas Heartbeat Act will be struck down and never replicated in other states or in the rest of Texas’ Pro-Life laws.
A liberal judge in Austin recently ruled against us in the 14 lawsuits Texas Right to Life is fending off to protect the Texas Heartbeat Act.
We filed an urgent appeal to the Supreme Court of Texas.
Abortion advocates hope with this lawsuit against Texas Right to Life they will:
- Stop Pro-Lifers from suing abortionists;
- Scare other states from saving babies with similar Pro-Life laws;
- Sue Texas Right to Life out of existence. (We’ve already been forced to spend over $300,000 in legal bills, and our insurance costs have skyrocketed.)
Although we’ve been hit with many attacks because of our life-saving work, God says: “We do not wrestle against flesh and blood, but… against the cosmic powers over this present darkness, against the spiritual forces of evil in the heavenly places.” Ephesians 6:12
As we fight the new business model of the abortion industry after Roe v. Wade, this approach of allowing citizens to sue abortionists who break the law will be essential.
Pro-abortion forces are not willing to drop this lawsuit, leaving Texas Right to Life with the burden of the legal defense and cost.
