15 Texas Reps. Demand Supreme Court Keep Abortion Pill Loosely Regulated

The battle over the abortion drug mifepristone has greatly intensified since the Supreme Court of the United States announced it would review the case last December. Over 640 state legislators filed a brief petitioning the Supreme Court to keep the FDA’s modifications on the drug which expanded abortion access.  

15 Texas lawmakers, relentlessly in favor of abortion rights signed onto this amicus brief in January. The lawmakers urged the Supreme Court to overrule a lower court’s decision that restricted access to the drug, because it “undermined state legislatures ability to decide whether to expand or restrict abortion access.” They argue that the decision undermines state legislator’s authority over abortion, contrary to the principles invoked in Dobbs. The brief also highlights the FDA’s authority to determine the safety of medications and under what conditions they may be used. 

Over the last couple of years the use of abortion pills has skyrocketed, due to the FDA’s decisions to suspend certain risk evaluations and mitigation strategies for the distribution of abortion pills. A study from the Charlotte Lozier Institute showed that increased access to abortion pills creates significant public health risks. 1 in 5 women will suffer a complication due to taking an abortion pill. 1 in 20 women will experience an abortion related ER visit after taking an abortion pill. A successful abortion will always result in the death of an innocent child.

Texas citizens must elect Pro-Life leaders to office to truly create a Pro-Life Texas. We must stand with boldness to protect those who are vulnerable. Thankfully, abortion pills are outlawed in Texas, though we still have more work to do to stop these dangerous drugs coming into our state and harming pregnant women and preborn children.  

The Supreme Court’s decision will determine the accessibility of mifepristone in this country. Whatever decision the Supreme Court makes would not directly affect the Pro-Life laws in Texas, but many Texas women are traveling out of state for abortion procedures or are ordering illegal abortion pills online. Every life holds value and must be protected. The Pro-Life movement must persistently stand firm in its mission to save lives.
