Democrats File 9 Bills and Counting to Legalize Elective Abortion Again in Texas

In just a few weeks, lawmakers will meet for the first time since the overturn of Roe v. Wade. Democrats have already filed legislation to legalize elective abortion again in Texas. Here’s a breakdown of the anti-Life bills we’ve seen so far. As the legislative session approaches, we will undoubtedly see even more attacks. 

  • “Proposing a constitutional amendment to limit the legislature’s ability to pass laws prohibiting access to abortion care”HJR 56 by Representative James Talarico (D-Round Rock) would enshrine abortion in the Texas Constitution. The proposed amendment would say, “The legislature shall not pass a law that abridges an individual’s access to abortion care if the individual’s decision to access abortion care is made in consultation with a licensed physician.”
  • “Relating to the repeal of laws prohibiting abortion”HB 819 by James Talarico would entirely repeal the Texas Heartbeat Act, the Human Life Protection Act (aka the trigger ban), and the pre-Roe abortion ban.
  • “Relating to protection of employers from liability and certain other penalties in connection with the provision of employee benefits” HB 27 by Representative Vikki Goodwin (D-Austin) would shield companies and employers from liability if they pay for their employees to travel out of state for an abortion.
  • “Relating to the provision of an abortion-inducing drug”SB 78 by Senator Nathan Johnson (D-Dallas) would legalize abortion-inducing drugs to kill preborn babies who are up to 10 weeks old.
  • “Relating to the repeal of certain laws prohibiting abortion and the construction of abortion laws imposing penalties or liability on pregnant individuals.” SB 79 by Senator Johnson would repeal our state’s abortion ban that passed before 1973 and regained effect this year when the Supreme Court overturned Roe. It also changes the word “woman” to “pregnant” individual”.
  • “Relating to the repeal of and exceptions to certain laws prohibiting abortion” SB 122 by Senator Carol Alvarado (D- Houston) would target babies conceived in rape for abortions. It also would repeal the pre-Roe abortion ban mentioned above, and replaces references to “women” with mentions of “pregnant patients”.
  • “Relating to exceptions to certain laws prohibiting abortion” SB 123 by Alvarado would discriminate against preborn children with disabilities, targeting them for abortions. It would also allow abortion when the mother’s mental health is in jeopardy, opening a massive loophole that essentially would negate all of our Pro-Life laws. The bill would also completely protect physicians from medical review if they commit an abortion under one of these exceptions. Finally, the bill would remove the words “preborn child”, “woman”, “female”, and “fertilization” from the law.
  • Relating to the repeal of laws prohibiting abortion” SB 227 by Sarah Eckhardt (D-Austin) would repeal the trigger law and the pre-Roe abortion ban, while changing the word “woman” to “pregnant individual.”
  • Proposing a constitutional amendment establishing an individual’s right to personal reproductive autonomy” SJR 21 by Eckhardt would enshrine abortion in our state constitution, placing a constitutional amendment on the November 2023 ballot that would completely eliminate our legislature’s ability to protect preborn children.
